  • Business plan preparation services
  • Application preparation and submission services
  • All communication and interactions with our team

3. Services Description

Immigration Consultation Services

We provide professional immigration consulting services, including but not limited to:

  • Assessment of eligibility for Canadian immigration programs
  • Startup Visa program consultation and application preparation
  • Business plan development and review
  • Liaison with designated organizations
  • Application preparation and submission
  • Ongoing case management and updates

Scope of Services

Our services are limited to immigration consultation and application preparation. We do not provide:

  • Legal advice (we are not lawyers)
  • Investment advice or financial planning
  • Guarantees of immigration approval
  • Assistance with illegal immigration activities
  • Services outside Canadian immigration law

4. Professional Standards and Licensing

RCIC Professional Standards

Our consultants are Regulated Canadian Immigration Consultants (RCIC) licensed by the College of Immigration and Citizenship Consultants (CICC). We adhere to all professional standards, codes of conduct, and continuing education requirements mandated by CICC.

Professional Obligations

  • Maintain confidentiality of all client information
  • Provide competent and diligent representation
  • Act in the best interests of our clients
  • Comply with all applicable laws and regulations
  • Maintain professional indemnity insurance

5. Client Responsibilities

Information Accuracy

You agree to:

  • Provide complete, accurate, and truthful information
  • Promptly notify us of any changes to your circumstances
  • Respond to our requests for information in a timely manner
  • Review all documents carefully before approval
  • Inform us of any criminal history or immigration violations

Document Provision

You are responsible for:

  • Providing all required documents in the requested format
  • Ensuring documents are authentic and unaltered
  • Obtaining certified translations when required
  • Meeting all deadlines for document submission
  • Paying any associated costs for document preparation

6. Fees and Payment Terms

Fee Structure

Our fees are structured as follows:

  • Assessment Fee: CAD $1,000 (refundable if we cannot assist you)
  • Service Fee (First Payment): CAD $75,000 upon engagement
  • Success Fee (Final Payment): CAD $75,000 upon Letter of Support delivery

Payment Terms

  • All fees are quoted in Canadian Dollars (CAD)
  • Payment methods: Bank transfer, certified cheque, or as agreed
  • Fees are due within 15 business days of invoice date
  • Late payments may incur interest charges of 2% per month
  • All fees are exclusive of applicable taxes

Additional Costs

The following costs are separate from our professional fees:

  • Government application fees
  • Translation and notarization costs
  • Medical examinations and police certificates
  • Travel expenses for in-person meetings
  • Third-party professional services (if required)

7. Guarantee Terms

Our Service Guarantee

We guarantee to secure a Letter of Support from a designated organization within 90 days of engagement, or you receive a full refund of all fees paid.

This guarantee is subject to the terms and conditions outlined in your service agreement.

Guarantee Conditions

Our guarantee is valid provided that:

  • You meet all eligibility criteria as assessed
  • All information provided is accurate and complete
  • You comply with all requests and deadlines
  • Your circumstances do not materially change
  • No fraudulent or illegal activity is discovered

Guarantee Exclusions

The guarantee does not apply if:

  • Government policy changes affect program availability
  • You withdraw from the process voluntarily
  • Material information is withheld or misrepresented
  • You fail to meet agreed deadlines or requirements
  • Circumstances beyond our reasonable control occur

8. Limitation of Liability

Service Limitations

While we provide professional services with due care and competence, we cannot guarantee:

  • Approval of any immigration application by government authorities
  • Specific processing times by government agencies
  • Changes in immigration policies or requirements
  • Outcomes of third-party assessments or decisions

Liability Cap

Our total liability to you for any claims arising from our services shall not exceed the total amount of fees paid to us for the specific service giving rise to the claim.

Excluded Damages

We shall not be liable for:

  • Indirect, consequential, or punitive damages
  • Lost profits or business opportunities
  • Emotional distress or mental anguish
  • Delays caused by government processing
  • Third-party actions or decisions

9. Confidentiality

We maintain strict confidentiality regarding all client information in accordance with:

  • CICC professional standards and code of conduct
  • Canadian privacy legislation
  • Our internal confidentiality policies
  • Professional ethical obligations

Information Sharing

We may share your information only:

  • With your explicit written consent
  • As required by law or legal process
  • With government agencies as part of your application
  • With designated organizations for your Startup Visa application
  • With professional service providers bound by confidentiality

10. Termination

Termination by Client

You may terminate our services at any time by providing 30 days written notice. Upon termination:

  • You remain responsible for fees for services already provided
  • We will provide you with copies of all your documents
  • Confidentiality obligations remain in effect
  • Any refunds will be calculated pro-rata for unused services

Termination by Us

We may terminate our services if:

  • You fail to pay fees when due
  • You provide false or misleading information
  • You fail to cooperate or meet agreed deadlines
  • Continuing the relationship would violate professional standards
  • A conflict of interest arises that cannot be resolved

11. Dispute Resolution

Internal Resolution

We encourage resolving disputes through direct communication. Our dispute resolution process includes:

  • Initial discussion with your assigned consultant
  • Escalation to senior management if unresolved
  • Review by our internal complaints committee
  • Mediation by an independent third party if necessary

External Resolution

If internal resolution is unsuccessful, disputes may be resolved through:

  • Complaints to the College of Immigration and Citizenship Consultants (CICC)
  • Binding arbitration under the laws of Ontario, Canada
  • Court proceedings in the Province of Ontario, Canada

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal action or proceeding arising under these terms shall be brought exclusively in the courts of Ontario, Canada.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. We will notify active clients of material changes via email. Your continued use of our services after changes constitute acceptance of the modified terms.

14. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.

15. Entire Agreement

These Terms of Service, together with our Privacy Policy and any service agreements, constitute the entire agreement between you and Your Immigration Your Way regarding the use of our services and supersede all prior understandings and agreements.

16. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, or extreme weather conditions
  • War, terrorism, civil unrest, or government actions
  • Pandemics, epidemics, or public health emergencies
  • Internet or telecommunications failures
  • Government policy changes or regulatory actions

17. Professional Insurance

As required by CICC regulations, we maintain professional indemnity insurance to protect against errors and omissions in our professional services. Coverage details are available upon request.

18. Anti-Money Laundering Compliance

In accordance with Canadian anti-money laundering legislation, we are required to:

  • Verify the identity of all clients
  • Maintain records of financial transactions
  • Report suspicious transactions to FINTRAC
  • Comply with sanctions and watch list screening

You consent to these verification and reporting requirements as a condition of service.

19. Electronic Communications

By using our services, you consent to receive communications from us electronically. We may communicate with you by email or by posting notices on our website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
